The terms governing use of TradingSurv, including the limits on how surveillance output may be relied upon and the licensing of the market data behind it.

The service

TradingSurv provides a hosted console for monitoring European wholesale power markets. It collects published market data, normalises it, and produces analytical output including reconstructed merit orders and surveillance screens.

How output may be relied upon

This is the clause that matters most, and it says the same thing the product does: surveillance output is an indicator for human review, not a determination that market abuse has occurred, and not legal or regulatory advice.

A finding is a statement that a model built from published data could not account for an observed outcome within its calibrated error. It is not evidence of intent, and it is not a conclusion about any market participant’s conduct. Decisions to investigate, escalate or report remain the customer’s, and the customer remains solely responsible for its own regulatory obligations under REMIT, MAR and any equivalent regime.

Accuracy and availability

The service depends on data published by third parties — exchanges, transmission system operators and regulatory platforms. Those upstreams can be late, incomplete, revised after publication or unavailable, and TradingSurv does not warrant their accuracy. Where a feed fails, the service is designed to say so rather than present stale data as current.

The service is provided without any warranty that it will be uninterrupted or error-free.

Market data licensing

Market data displayed in the console originates from third-party sources whose own terms govern its use, including restrictions on redistribution. Customers may use the data within the service for their own internal surveillance and compliance purposes. Extracting it for onward redistribution, resale or publication may require a licence directly from the originating source, and obtaining one is the customer’s responsibility.

Accounts and acceptable use

An account is for a named individual and must not be shared. Customers must not attempt to circumvent access controls, extract data by means other than the interfaces provided, or use the service in a way that degrades it for others.

Billing and termination

Paid subscriptions are billed through Stripe on the cycle selected at checkout. Either party may terminate at any time; a subscription cancelled mid-cycle runs to the end of the period already paid for. On termination, organisation-scoped data is deleted on request.

Changes

These terms may be updated. Material changes will be notified to account holders before they take effect.
